Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Kshaf, available at kshaf.ai, and any related website-building, hosting, subscription, support, domain, SEO, AI-search-readiness, and digital presence services provided by Reactor Technology OÜ, a company registered in Estonia with its address at Harju maakond, Tallinn, Kesklinna linnaosa, Narva mnt 5, 10117 Estonia ("Kshaf", "we", "us", or "our").
By creating an account, starting a free trial, purchasing a subscription, using the Kshaf platform, or requesting any Kshaf service, you agree to these Terms. If you do not agree to these Terms, you must not use the Services.
These Terms apply globally, subject to any mandatory consumer protection rights that may apply in your country of residence.
1. Definitions
In these Terms, the following words have the meanings set out below:
Account means the account created by you to access the Kshaf dashboard, manage your website, subscription, requests, billing, and related Services.
Business Website means the website created, configured, hosted, or managed by Kshaf for your business as part of the Services.
Client Content means any business information, text, images, logos, brand assets, videos, product or service information, prices, contact details, social media links, business descriptions, reviews, and other materials provided by you or made available by you for use in the Services.
Dashboard means the Kshaf online account area where you may access available features, manage your subscription, request edits, cancel your plan, or communicate with Kshaf.
Domain Name means any domain name used for your Business Website, whether provided by you or registered/provided by Kshaf as part of the Services.
Fair Use means reasonable use of support and edit requests in line with the purpose of the subscription, as further described in Section 7.
Free Trial means the 7-day trial period offered by Kshaf to eligible new customers.
Kshaf Techproprietary technology, software, systems, templates, website infrastructure, hosting setup, internal tools, AI-assisted workflows, designs, platform, code, databases, and other technical components used to create, operate, manage, and host Business Websites.
Order Summary means the checkout page, confirmation email, invoice, subscription page, or dashboard summary showing the plan you selected, billing period, price, start date, and any applicable promotional offer.
Services means all services provided by Kshaf, including website creation, website hosting, domain-related services, dashboard access, website management, edit requests, support, SEO setup, AI search readiness, mobile optimization, conversion-focused layouts, contact flows, map setup, WhatsApp/contact buttons, booking or lead features, and any additional services offered by Kshaf.
Subscription means the paid recurring plan selected by you, including monthly, yearly, or two-year billing options.
User Data means personal data collected, submitted, or processed through your use of the Services, including contact form submissions, booking requests, customer messages, account information, and related data.
2. Eligibility
2.1 You must be at least 21 years old to create an Account, start a Free Trial, purchase a Subscription, or use the Services.
2.2 By using Kshaf, you confirm that:
a. you are at least 21 years old;
b. you have the legal authority to act on behalf of the business you register with Kshaf;
c. all information you provide to Kshaf is accurate, complete, and up to date; and
d. your use of the Services will comply with all applicable laws and regulations.
2.3 Kshaf may refuse, suspend, or terminate access to the Services if we believe that you do not meet these eligibility requirements or that your business is not suitable for the Services.
3. Services Provided by Kshaf
3.1 Kshaf provides managed website services for businesses. Depending on your plan and available features, the Services may include:
a. creation of a professional Business Website;
b. hosting and technical operation of the Business Website;
c. mobile-friendly website design;
d. conversion-focused website layout;
e. basic SEO setup;
f. AI-search-readiness structure;
g. contact forms, WhatsApp buttons, phone links, maps, or booking-related features;
h. domain connection or domain provision, where applicable;
i. dashboard access;
j. ongoing website edits and support under Fair Use; and
k. other related digital presence services offered by Kshaf.
3.2 Kshaf may improve, modify, replace, or remove features from time to time, provided that such changes do not materially reduce the core functionality of your active paid plan.
3.3 Kshaf reserves the right to decide the technical structure, platform, hosting environment, software, templates, integrations, and infrastructure used to provide the Services.
3.4 Kshaf is not a traditional one-time website development agency. The Business Website is provided as part of an active managed subscription and is powered by Kshaf Technology.
4. 24-Hour Website Delivery
4.1 Kshaf may advertise that eligible Business Websites can be built or launched within 24 hours.
4.2 The 24-hour delivery period begins only after:
a. your Account and Subscription or Free Trial are active;
b. you have provided all required business information, content, access, approvals, and instructions requested by Kshaf; and
c. there are no technical, domain, payment, content, third-party, or compliance issues preventing delivery.
4.3 The 24-hour delivery promise applies to the initial website version and does not guarantee that all advanced custom requests, third-party approvals, domain propagation, search engine indexing, or additional edits will be completed within 24 hours.
4.4 Kshaf is not responsible for delays caused by incomplete information, late responses, unavailable domain names, third-party platforms, DNS propagation, payment issues, unsupported requests, or force majeure events.
5. Free Trial
5.1 Kshaf may offer a 7-day free trial to eligible new customers.
5.2 During the Free Trial, you may access the Services according to the features and limitations shown at signup.
5.3 Unless cancelled before the end of the Free Trial, your selected Subscription may automatically convert into a paid Subscription at the end of the Free Trial.
5.4 You are responsible for cancelling before the Free Trial ends if you do not wish to continue with a paid Subscription.
5.5 Kshaf may modify, withdraw, limit, or refuse the Free Trial at any time, including where we suspect abuse, fraud, duplicate accounts, or misuse.
6. Subscription Plans, Billing, and Payment
6.1 Kshaf offers recurring Subscription plans. Current billing options may include:
a. Monthly plan: USD 20 per month;
b. Yearly plan: billed annually with two months free; and
c. Two-year plan: billed every two years with six months free.
6.2 The exact price, billing cycle, plan features, promotional offers, and applicable taxes will be shown at checkout, in your Order Summary, invoice, dashboard, or confirmation email.
6.3 Payments are processed through Stripe or other payment processors selected by Kshaf. Kshaf does not store your full credit card details.
6.4 By entering payment details, you authorize Kshaf and its payment processor to charge your selected payment method for recurring Subscription fees, renewal payments, taxes, and any approved additional services.
6.5 Subscriptions renew automatically unless cancelled before the next renewal date.
6.6 Yearly and two-year plans are billed upfront for the full selected billing period. The "free months" are promotional discounts applied to the relevant billing period and do not create separate refundable monthly credits unless required by law.
6.7 If payment fails, Kshaf may retry the payment, request updated payment details, suspend the Services, remove public access to the Business Website, or terminate your Account.
6.8 All prices are exclusive of taxes unless stated otherwise. You are responsible for any applicable VAT, sales tax, withholding tax, or similar charges.
6.9 Kshaf may change its pricing. Price changes will not affect your current paid billing period but may apply to future renewals after notice is provided where required by law.
7. Website Edits, Support, and Fair Use
7.1 Active subscribers may request edits and support through the Dashboard, email, or other approved support channels.
7.2 Edits are provided under a Fair Use policy. Fair Use means reasonable edit requests that are consistent with maintaining and improving a small business website.
7.3 Fair Use may include reasonable changes to text, images, sections, contact details, service descriptions, opening hours, prices, buttons, links, and similar website content.
7.4 Fair Use does not include:
a. rebuilding the entire website repeatedly;
b. creating multiple unrelated websites under one Subscription;
c. advanced custom software development;
d. complex integrations not included in your plan;
e. large-scale content production;
f. excessive, abusive, repetitive, or unreasonable requests;
g. urgent work outside normal support capacity;
h. requests that require third-party paid tools unless separately agreed; or
i. work that Kshaf considers outside the scope of the plan.
7.5 Kshaf may refuse, delay, limit, or quote separately for requests that fall outside Fair Use.
7.6 Kshaf aims to respond to support requests in a reasonable time but does not guarantee immediate response or completion times unless expressly agreed in writing.
8. Domain Names
8.1 If you provide your own Domain Name, you remain responsible for owning, renewing, managing, and maintaining that Domain Name.
8.2 If Kshaf provides or registers a Domain Name as part of the Services, the Domain Name is owned or controlled by Kshaf unless otherwise agreed in writing.
8.3 If your plan is cancelled, expires, or is terminated, any Kshaf-provided Domain Name may remain under Kshaf ownership or control.
8.4 Kshaf does not guarantee that a requested Domain Name will be available.
8.5 If your own Domain Name is connected to your Business Website, you are responsible for maintaining access to your registrar, DNS settings, email records, and renewals.
8.6 Kshaf is not responsible for downtime, lost emails, lost domains, DNS errors, or business loss caused by your failure to renew or manage a Domain Name that you own.
9. Website Ownership, Licensing, and Access After Cancellation
9.1 Kshaf provides Business Websites as an active managed subscription service powered by Kshaf Technology.
9.2 You retain ownership of your Client Content, including your business name, logo, images you own, brand materials, and business information.
9.3 Kshaf retains ownership of Kshaf Technology, including the website system, templates, software, code, hosting setup, dashboard, workflows, infrastructure, design systems, and other technical components used to provide the Services.
9.4 During an active Subscription, Kshaf grants you a limited, non-exclusive, non-transferable, revocable license to use the Business Website as part of the Services.
9.5 If your Subscription is cancelled, expires, remains unpaid, or is terminated, the Business Website may be taken offline and your access to the Services may end.
9.6 Because the Business Website is powered by Kshaf Technology, it is not transferable as a standalone website to another host or platform unless Kshaf separately agrees in writing.
9.7 Kshaf is not required to provide source code, platform access, server access, database exports, template files, design files, or copies of Kshaf Technology.
9.8 Upon request, Kshaf may provide a reasonable export of your Client Content where technically possible and legally required.
10. SEO, Google Visibility, AI Search Readiness, and Business Results
10.1 Kshaf may provide SEO setup, local visibility improvements, structured content, performance-focused layouts, AI-search-readiness, and other digital presence features.
10.2 Kshaf does not guarantee:
a. specific Google rankings;
b. indexing by Google or any search engine;
c. visibility in AI search engines or AI assistants;
d. traffic volume;
e. leads, calls, bookings, messages, sales, revenue, or profit;
f. approval by third-party platforms; or
g. that your competitors will not outrank you.
10.3 Search engines, AI tools, maps platforms, social platforms, and advertising platforms are controlled by third parties. Their ranking systems, policies, algorithms, and display decisions are outside Kshaf's control.
10.4 Any examples, case studies, testimonials, projections, or performance statements are illustrative only and do not guarantee similar results for your business.
10.5 You are responsible for the quality of your services, pricing, customer experience, reputation, reviews, operations, and sales process.
11. Third-Party Services and Integrations
11.1 The Services may include or connect with third-party services, including payment processors, hosting providers, analytics tools, maps, booking tools, messaging apps, social media platforms, search engines, AI platforms, domain registrars, email providers, and other integrations.
11.2 Third-party services are subject to their own terms, policies, fees, technical limits, and availability.
11.3 Kshaf is not responsible for third-party outages, policy changes, account restrictions, rejected listings, suspended accounts, API changes, pricing changes, or loss of functionality caused by third-party providers.
11.4 You authorize Kshaf to access, configure, connect, or manage third-party accounts where necessary to provide the Services, provided that you supply the required access or approval.
11.5 You remain responsible for complying with the terms and policies of any third-party services you use.
12. Client Content and Permissions
12.1 You grant Kshaf a worldwide, non-exclusive, royalty-free license to use, copy, edit, adapt, publish, display, distribute, and process Client Content only as reasonably necessary to provide, improve, market, and support the Services.
12.2 You confirm that you have all necessary rights, licenses, permissions, and consents to provide Client Content to Kshaf.
12.3 You are responsible for ensuring that Client Content is accurate, lawful, not misleading, and does not infringe any third-party rights.
12.4 Kshaf may remove, edit, or refuse to publish Client Content if we believe it is unlawful, misleading, offensive, harmful, infringing, or unsuitable for the Services.
12.5 Kshaf may use your business name, logo, website screenshot, and public-facing Business Website as part of Kshaf's portfolio, marketing, case studies, or promotional materials unless you request otherwise in writing.
13. Customer Responsibilities
13.1 You agree to:
a. provide accurate and complete business information;
b. keep your Account login details secure;
c. respond to reasonable requests from Kshaf;
d. review and approve website content where requested;
e. comply with all applicable laws and regulations;
f. ensure your products and services are lawful in the countries where you operate;
g. maintain any required business licenses, permits, professional approvals, or regulatory registrations; and
h. use the Services only for lawful business purposes.
13.2 You must not:
a. misuse, copy, reverse engineer, scrape, attack, or interfere with Kshaf Technology;
b. use the Services to publish illegal, fraudulent, defamatory, abusive, misleading, hateful, adult, violent, or harmful content;
c. infringe intellectual property rights;
d. upload viruses, malware, harmful code, or automated scripts;
e. use the Services for spam, phishing, scams, or deceptive marketing;
f. resell the Services without Kshaf's written consent;
g. create multiple accounts to abuse free trials or promotions; or
h. use the Services in a way that may harm Kshaf, other customers, or third parties.
14. Prohibited and Restricted Businesses
14.1 Kshaf may refuse or terminate Services for businesses, products, or services that we consider illegal, high-risk, harmful, misleading, or unsuitable.
14.2 Restricted categories may include, but are not limited to:
a. illegal goods or services;
b. fraudulent schemes;
c. counterfeit goods;
d. hate, harassment, or extremist content;
e. adult sexual content or services;
f. gambling or betting services where not lawfully licensed;
g. weapons or dangerous goods;
h. controlled substances or illegal drugs;
i. misleading medical, financial, or legal claims;
j. businesses that violate third-party platform policies; or
k. any category that Kshaf or its payment processor cannot support.
14.3 Kshaf may suspend or remove any Business Website that violates this section.
15. Cancellation
15.1 You may cancel your Subscription through the Dashboard or by contacting Kshaf at info@kshaf.ai.
15.2 Cancellation will take effect at the end of your current billing period unless otherwise required by law or confirmed by Kshaf in writing.
15.3 If you cancel during a Free Trial, you will not be charged for the paid Subscription if cancellation is completed before the trial ends.
15.4 If you cancel a paid Subscription, your Business Website may remain active until the end of the paid billing period, after which it may be taken offline.
15.5 Kshaf is not responsible for your failure to cancel before a renewal date.
15.6 Deleting content, disconnecting a domain, not using the Services, or sending informal messages through unapproved channels may not automatically cancel your Subscription.
16. 30-Day Money-Back Guarantee and Refunds
16.1 Kshaf offers eligible new customers a 30-day money-back guarantee.
16.2 The 30-day period begins on the date of your first paid Subscription payment, unless otherwise stated at checkout.
16.3 To request a refund under the money-back guarantee, you must contact Kshaf at info@kshaf.ai or use the cancellation/refund option available in the Dashboard.
16.4 The money-back guarantee applies only to your first Subscription purchase and may not apply to renewals, repeat purchases, additional services, custom work, third-party fees, domain fees, or customers who abuse the policy.
16.5 If a custom Domain Name has been purchased, registered, or provided by Kshaf, Kshaf may deduct the cost of that Domain Name or exclude domain-related costs from the refund where permitted by law.
16.6 After the 30-day money-back period, payments are non-refundable unless required by applicable law or expressly agreed by Kshaf in writing.
16.7 Refunds may be processed through Stripe or the original payment method and may take time depending on the payment processor and your bank.
16.8 If you are a consumer located in the European Union, you may have mandatory consumer rights that cannot be excluded by these Terms.
17. Suspension and Termination
17.1 Kshaf may suspend or terminate your Account, Business Website, or access to the Services immediately if:
a. payment is overdue or fails;
b. you breach these Terms;
c. you misuse the Services;
d. your business or content is illegal, misleading, harmful, or unsupported;
e. required information is inaccurate or incomplete;
f. you violate third-party platform rules;
g. your use creates legal, technical, security, or reputational risk; or
h. Kshaf is required to do so by law, regulation, court order, payment processor, or third-party provider.
17.2 Upon termination or cancellation:
a. your right to use the Services ends;
b. your Business Website may be taken offline;
c. Kshaf may stop hosting and supporting your Business Website;
d. unpaid amounts remain due; and
e. sections of these Terms that should reasonably survive termination will continue to apply.
17.3 Kshaf may delete inactive, cancelled, suspended, or terminated websites and Account data after a reasonable period, unless retention is required by law or necessary for legitimate business purposes.
18. Data Protection and Privacy
18.1 Kshaf processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation where applicable.
18.2 Details about how Kshaf collects, uses, stores, and protects personal data should be set out in Kshaf's Privacy Policy.
18.3 You are responsible for ensuring that your own use of User Data collected through your Business Website complies with applicable privacy, marketing, consumer, and data protection laws.
18.4 If your Business Website collects customer messages, booking requests, form submissions, or other personal data, you must use that data lawfully and only for appropriate business purposes.
18.5 You must not use the Services to collect sensitive personal data unless you have a lawful basis and all required notices, consents, and safeguards.
19. Intellectual Property
19.1 Kshaf and its licensors own all rights in Kshaf Technology, the Kshaf brand, platform, software, systems, templates, website infrastructure, dashboard, workflows, and other materials created or provided by Kshaf, except for Client Content.
19.2 You must not copy, reproduce, sell, license, reverse engineer, duplicate, modify, or create derivative works from Kshaf Technology without written permission.
19.3 You retain ownership of your Client Content, subject to the license granted to Kshaf under these Terms.
19.4 Feedback, suggestions, ideas, or improvement requests you provide to Kshaf may be used by Kshaf without restriction or compensation.
20. Disclaimers
20.1 The Services are provided on an "as is" and "as available" basis.
20.2 Kshaf aims to provide reliable Services, but we do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times.
20.3 Kshaf does not guarantee that the Business Website will meet every expectation, generate specific results, be compatible with every third-party tool, or remain free from downtime or technical issues.
20.4 Kshaf is not responsible for:
a. loss of revenue, profit, customers, leads, rankings, traffic, or business opportunities;
b. third-party platform changes or outages;
c. search engine or AI engine ranking decisions;
d. domain or DNS delays;
e. payment processor issues;
f. Client Content errors;
g. your failure to provide required information; or
h. events outside Kshaf's reasonable control.
21. Limitation of Liability
21.1 Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.
21.2 To the maximum extent permitted by law, Kshaf will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profit, revenue, goodwill, customers, data, rankings, traffic, or business opportunity.
21.3 To the maximum extent permitted by law, Kshaf's total liability arising out of or relating to the Services will be limited to the amount you paid to Kshaf for the Services during the 12 months immediately before the event giving rise to the claim.
21.4 This limitation applies whether the claim is based on contract, tort, negligence, strict liability, statute, or any other legal theory.
22. Indemnity
22.1 You agree to indemnify and hold harmless Kshaf, Reactor Technology OÜ, its directors, employees, contractors, partners, affiliates, and suppliers from any claims, losses, liabilities, damages, costs, and expenses arising from:
a. your breach of these Terms;
b. your Client Content;
c. your products, services, business operations, or customer relationships;
d. your misuse of the Services;
e. your violation of law;
f. your infringement of third-party rights; or
g. claims made by your customers or website visitors.
23. Marketing Communications
23.1 By creating an Account, starting a Free Trial, purchasing a Subscription, or submitting your contact details, you agree that Kshaf may contact you about your Account, Services, billing, product updates, offers, and marketing communications.
23.2 You may unsubscribe from marketing emails at any time using the unsubscribe link or by contacting info@kshaf.ai.
23.3 Service, billing, security, and legal emails may still be sent where necessary.
24. Changes to the Services and Terms
24.1 Kshaf may update these Terms from time to time.
24.2 The latest version will be posted on kshaf.ai or made available through the Dashboard.
24.3 If changes are material, Kshaf may notify you by email, dashboard notice, or other reasonable method.
24.4 Continued use of the Services after updated Terms become effective means you accept the updated Terms.
25. Force Majeure
25.1 Kshaf will not be responsible for delay or failure to perform caused by events outside its reasonable control, including natural disasters, war, terrorism, riots, strikes, government action, internet failures, hosting outages, cyberattacks, payment processor issues, third-party platform outages, or technical failures beyond Kshaf's control.
26. Assignment
26.1 You may not assign, transfer, or sublicense your rights or obligations under these Terms without Kshaf's prior written consent.
26.2 Kshaf may assign or transfer its rights and obligations under these Terms to an affiliate, successor, acquirer, or in connection with a merger, acquisition, restructuring, or sale of assets.
27. Severability
27.1 If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable.
27.2 The remaining provisions will continue in full force and effect.
28. No Waiver
28.1 If Kshaf does not enforce a right under these Terms, this does not mean Kshaf waives that right.
28.2 Any waiver must be made in writing to be effective.
29. Governing Law and Jurisdiction
29.1 These Terms are governed by the laws of Estonia, subject to any mandatory consumer protection laws that may apply in your country of residence.
29.2 Any disputes arising from or relating to these Terms or the Services will be subject to the competent courts of Estonia, unless mandatory applicable law gives you the right to bring a claim elsewhere.
29.3 If you are a consumer in the European Union, you may have additional rights under EU consumer protection law that cannot be excluded by these Terms.
